										<content:encoded><![CDATA[<p>Elon Musk’s lawyer is accusing a San Francisco federal jury of “mocking” the billionaire by including “$4.20” among the figures for recommended damages in a class-action suit that accused the tech titan of misleading Twitter investors.</p>
<p>In a Thursday letter to US District Judge Charles Breyer, defense attorney Alex Spiro argued the verdict was “corrupted” by bias and denied his client a fair trial.</p>
<p>Spiro is seeking a probe into the matter — to be followed by a motion seeking a ruling in favor of Musk or a new trial.</p>

<p>The laywer cited a handwritten verdict form in which jurors listed “$4.20” for one damages entry — written in bright blue ink while the rest of the entries were black.</p>
<p>Spiro said the unusual entry was no accident, calling it a deliberate jab at Musk tied to his well-known association with the number 420.</p>
<p>“The inescapable conclusion,” the attorney wrote, “is that the jury felt it appropriate to use its verdict to send a message to Mr. Musk.”</p>
<p>He accused jurors of injecting “outside influence and noise” into what should have been a neutral deliberation.</p>
<p>The number 420 is widely recognized as slang for marijuana and has been part of a running joke by Musk.</p>
<p>In 2018, he tweeted he was considering taking Tesla private at “$420” — a post that triggered an SEC fraud case — and later set his Twitter buyout price at $54.20 per share, reinforcing the association.</p>
<p>The jury found last week that Musk defrauded investors by intentionally driving down Twitter’s stock price before he acquired it in 2022, later renaming it X.</p>

<p>Spiro argued in his letter filed Thursday that the jury wasn’t actually “deciding a securities fraud case” but sending Musk a message.</p>
<p>“The jury’s emphasis on the $4.20 number, which had no significance to its damages determination, but appears to be a mocking reference to a number previously associated with Mr. Musk, shows that the verdict was a mockery of justice: a commentary not on whether Mr. Musk committed securities fraud (he did not) but on the jury’s views about Mr. Musk himself,” Spiro wrote.</p>
<p>“No reasonable and experienced person could have any faith in the fairness of this proceeding or its resulting verdict,” he concluded.</p>
<p>Plaintiffs in the high-stakes case had alleged Musk made public statements about the prevalence of spam accounts and the status of the Twitter deal that depressed the company’s stock price, harming traders who sold shares or related options during the period.</p>

<p>The jury found Musk liable for some of the fraud claims — but rejected the main allegation, that he conducted a deliberate “scheme” to manipulate Twitter’s stock price.</p>
<p>In his Thursday letter, Spiro claimed Musk was deprived of his chosen counsel after plaintiffs’ lawyers indicated they intended to call Spiro himself as a witness — a move that would create a conflict under the advocate-witness rule.</p>
<p>The lawyer, of Manhattan-based powerhouse firm Quinn Emanuel Urquhart &amp; Sullivan, said he was forced to step back from a jury-facing role as a result. However, plaintiffs never called him to testify.</p>

<p>“I remained concerned that Mr. Musk would be unable to seat an impartial jury given his notoriety and reputation in the District,” Spiro wrote in the letter.</p>
<p>He pointed to comments from Judge Breyer during jury selection — including that “[m]aybe if I went in a different part of the country, I might get a different panel” — as evidence the jury pool was biased.</p>
<p>According to the filing, the court was forced to accept jurors with preexisting views because excluding all potentially biased candidates would have made it impractical to seat a panel.</p>

<p>Taken together, the arguments lay the groundwork for a formal motion seeking a new trial or mistrial — a move that could upend the verdict just days after it was reached.</p>
<p>In a notable aside, Spiro also referenced a separate legal battle in Delaware. He took a swipe at Chancellor Kathaleen McCormick, the jurist who twice denied Musk a substantial payday from Tesla shareholders.</p>
<p>Spiro noted that McCormick had publicly reacted to a verdict in yet another case by endorsing a LinkedIn post celebrating an outcome against Musk.</p>
<p>Musk recently demanded McCormick recuse herself from the Delaware case, a class action lawsuit against Tesla.</p>
<p>McCormick responded that the apparent endorsement may have been accidental — or something else entirely.</p>
<p>“I either did not click the ‘support’ icon at all, or I did so accidentally,” she wrote, adding: “I do not believe that I did it accidentally.”</p>

										<content:encoded><![CDATA[<p>Microsoft on Tuesday unveiled a partnership with SpaceX’s Starlink to expand internet connectivity around the world – signaling its openness to working with Elon Musk’s companies despite the exec’s feud with OpenAI, with which Microsoft has a strategic partnership.</p>
<p>The world’s richest person has been engaged in a heated legal battle with OpenAI co-founder Sam Altman – demanding $134 billion from both Microsoft and OpenAI and saying he deserves the “wrongful gains” reaped from his early support of the start-up, according to court filings.</p>
<p>But it seems the software giant isn’t holding a grudge against Musk, announcing a partnership between Microsoft, Starlink and an internet service provider in Kenya to connect 540 community hubs throughout the country, according to a Microsoft blog post.</p>

<p>“Through our collaboration with Starlink, Microsoft is combining low-Earth orbit satellite connectivity with community-based deployment models and local ecosystem partnerships,” Microsoft’s chief sustainability officer, Melanie Nakagawa, wrote in the post.</p>
<p>“This is intended to expand the set of tools available to deliver digital access while remaining firmly embedded in a holistic, partnership-driven approach.”</p>
<p>The deal adds to growing demand for Musk’s space company, which holds several government contracts with the Department of War and NASA – and is reportedly weighing an IPO this year.</p>
<p>Musk has floated going public in mid-June, as the company aims to raise up to $50 billion at a $1.5 billion valuation, the Financial Times previously reported.</p>
<p>Meanwhile, the tech titan has launched a relentless court battle against OpenAI, alleging the ChatGPT-maker violated its founding mission by transforming into a for-profit entity.</p>
<p>Musk co-founded OpenAI in 2015 alongside Altman and several others, including LinkedIn founder and Microsoft board member Reid Hoffman.</p>
<p>On his social media platform X, home to the xAI chatbot Grok, Musk has taken aim at Microsoft, arguing it “has a responsibility to investigate” Hoffman’s ties to the late financier and convicted sex offender Jeffrey Epstein.</p>

<p>A batch of the Epstein files released earlier this year revealed correspondence discussing Hoffman’s visits to Epstein’s infamous private island, New Mexico ranch and New York apartment.</p>
<p>Hoffman has said that he knew Epstein through a fundraising relationship with the Massachusetts Institute of Technology and regrets their contact.</p>
<p>Musk and Altman have repeatedly traded barbs on social media – most recently dissolving into an ugly fight over whose technology has killed more people: Musk’s Tesla Autopilot or Altman’s ChatGPT.</p>
<p>Earlier this month, Musk announced that SpaceX would merge with xAI, his tech startup behind the Grok chatbot.</p>
<p>Microsoft’s Foundry cloud software is built to support Grok models, the company said last year.</p>

<p>Elon Musk&#8217;s xAI, which merged with SpaceX last week, is facing increased pressure from environmental and civil rights groups over pollution concerns, this time at the company&#8217;s facility in Southaven, Mississippi. </p>
<p>On Friday, the Southern Environmental Law Center and Earthjustice, on behalf of the NAACP, sent a notice of intent to sue xAI and subsidiary MZX Tech LLC, saying the company&#8217;s use of dozens of natural gas-burning turbines requires a federal permit, violates the Clean Air Act and harms nearby communities. </p>
<p>Pollution from the turbines, which xAI has also used in Memphis, Tennessee, for its Colossus 1 and Colossus 2 data centers, has been a major source of local contention for more than a year. </p>
<p>Plans for a third data center in Southaven, located about 20 miles from Memphis, were announced early this year, when Mississippi Republican Governor Tate Reeves said he expected the project to create &#8220;hundreds of permanent jobs throughout DeSoto County.&#8221;</p>
<p>Launched by Musk in 2023, xAI is trying to compete with OpenAI, Anthropic and <span class="QuoteInBody-quoteNameContainer" data-test="QuoteInBody" id="RegularArticle-QuoteInBody-5">Google<span class="QuoteInBody-inlineButton"><span class="AddToWatchlistButton-watchlistContainer" id="-WatchlistDropdown" data-analytics-id="-WatchlistDropdown"><span class="AddToWatchlistButton-addWatchListFromTag"/></span></span></span> in the booming generative AI market. On Feb. 2, Musk said SpaceX, his rocket maker and defense contractor, acquired xAI in a deal that valued the combined entity at $1.25 trillion. </p>
<p>Musk is banking on the area in and around Memphis as the foundation of his AI ambitions, and he&#8217;s been flouting environmental rules in order to develop as quickly as possible. Musk&#8217;s social network X, formerly Twitter, is also owned by xAI, which created the Grok AI chatbot and image generator.</p>
<p>XAI is currently under a myriad of government investigations in Europe, Asia and the U.S. after Grok enabled users to easily create and share deepfake porn, including explicit imagery depicting child sexual abuse.  </p>
<p>Last year, residents in the majority-Black community of Boxtown in South Memphis testified at public hearings about a stench in the air, and the impact of worsening smog on their health caused by xAI&#8217;s use of natural gas turbines. Research by scientists at the University of Tennessee also found that xAI&#8217;s turbine use added to air pollution woes in the area.</p>
<p>Environmental advocates, including the NAACP, had previously said they would sue to stop xAI&#8217;s un-permitted use of the turbines in Memphis. But they stopped short of filing a legal complaint after Shelby County&#8217;s health department allowed xAI to treat the turbines as temporary, non-road engines, and issued permits for their use. </p>
<p>At the federal level, the EPA recently clarified gray areas of the law and said these turbines can&#8217;t be categorized as temporary non-road engines. Nonetheless, xAI has been using the turbines across state lines without obtaining federal permits. </p>
<p>XAI didn&#8217;t immediately respond to a request for comment.</p>
<p>Noise pollution from the turbines has also been a source of local consternation. Jason Haley, a Southaven resident, told CNBC the turbines make headache-inducing noises around the clock that he can hear inside his home.</p>
<p>Haley is part of a group called Safe and Sound which documents the decibel levels, and is pressing local officials to stop xAI from making so much noise, especially overnight, with its turbines.</p>
<p>Mississippi officials will hold a public hearing, scheduled for Tuesday, for community members who wish to express their concerns about xAI&#8217;s expansion plans in the area. The hearing will focus on whether the state should give xAI permission to install and run 41 permanent turbines at its Southaven facility, Mississippi Today previously reported. </p>
<p>Similar community dynamics are playing out across the U.S. as tech giants rush to construct massive data centers, which can strain local energy and water supply and cause prices to increase.</p>
<p>In November, <span class="QuoteInBody-quoteNameContainer" data-test="QuoteInBody" id="RegularArticle-QuoteInBody-11">Microsoft<span class="QuoteInBody-inlineButton"><span class="AddToWatchlistButton-watchlistContainer" id="-WatchlistDropdown" data-analytics-id="-WatchlistDropdown"><span class="AddToWatchlistButton-addWatchListFromTag"/></span></span></span> ended efforts to build a data center in Wisconsin due to the community&#8217;s vocal opposition. <span class="QuoteInBody-quoteNameContainer" data-test="QuoteInBody" id="RegularArticle-QuoteInBody-13">Amazon<span class="QuoteInBody-inlineButton"><span class="AddToWatchlistButton-watchlistContainer" id="-WatchlistDropdown" data-analytics-id="-WatchlistDropdown"><span class="AddToWatchlistButton-addWatchListFromTag"/></span></span></span> also pulled out of plans for a data center in Arizona after community protests.</p>
<p>In terms of Musk&#8217;s Southaven project, Patrick Anderson, a senior attorney with SELC, said xAI &#8220;has to follow the law, just like any other company.&#8221;</p>
<p>&#8220;And when it flouts the Clean Air Act&#8217;s bedrock protections against unpermitted emissions, it puts the health and welfare of ordinary citizens at risk,&#8221; Anderson said in an email. &#8220;That&#8217;s why we intend to hold xAI accountable here.&#8221;</p>
<p>The Mississippi Department of Environmental Quality did not immediately respond to requests for comment. </p>

<p>Elon Musk said a primary reason for merging SpaceX with his artificial intelligence startup, xAI, is to more effectively build &#8220;orbital data centers.&#8221; That&#8217;s for a far-off future.</p>
<p>For now, xAI has a much more pressing need: cash. </p>
<p>In Monday&#8217;s blog post announcing the combination of his two companies, Musk estimated that &#8220;within 2 to 3 years, the lowest cost way to generate AI compute will be in space.&#8221; But xAI requires immense amounts of money to finance its massive infrastructure buildout as the three-year-old company tries to catch up to <span class="QuoteInBody-quoteNameContainer" data-test="QuoteInBody" id="RegularArticle-QuoteInBody-4">Google<span class="QuoteInBody-inlineButton"><span class="AddToWatchlistButton-watchlistContainer" id="-WatchlistDropdown" data-analytics-id="-WatchlistDropdown"><span class="AddToWatchlistButton-addWatchListFromTag" /></span></span></span>, OpenAI and Anthropic in the booming generative AI market. </p>
<p>SpaceX, which is reportedly aiming to go public this year in what could be a record-setting IPO, may represent Musk&#8217;s clearest path to landing that capital. The company is looking to raise up to $50 billion at a valuation as high as $1.5 trillion, according to Reuters. </p>
<p>A major key to SpaceX&#8217;s growth is Starlink, its satellite internet service, which has around 9,000 satellites in orbit today and roughly 9 million customers. It recently received authorization from the Federal Communications Commission to put<strong> </strong>another 7,500 satellites into orbit.</p>
<p>Tim Farrar, president of satellite and telecom industry research firm TMF Associates,<strong> </strong>said SpaceX can&#8217;t put that kind of money to work towards its existing business because there are only so many rocket launches available to get its Starlink satellites up into space each year. </p>
<p>Folding xAI into SpaceX, Farrar said, allows Musk to capitalize on investors&#8217; insatiable appetite for AI holdings, while also securing the AI company&#8217;s financial position despite its mounting losses. According to a report from The Information late Monday, xAI has told investors that it burned about $9.5 billion through the first nine months of 2025. </p>
<p>&#8220;People are throwing tens of billions of dollars at AI companies right now, and in six months or 12 months time, they might have changed their mind about it,&#8221; Farrar said. &#8220;Getting the money is feasible&#8221; now but may not be forever.</p>

<p>In early January, xAI closed a $20 billion funding round at about a $230 billion valuation. OpenAI was valued at $500 billion in October, and is reportedly looking to bump that up to about $750 billion in its next round. Anthropic signed a term sheet this month for a funding that values the company at $350 billion.</p>
<p>In addition to a friendly capital market, Musk has the benefit of an extremely favorable regulatory landscape, as the Trump administration rolls back environmental, antitrust and other regulations.</p>
<p>Nowhere in Monday&#8217;s blog post was there mention of any need for regulatory approval, and Musk suggested in the first sentence of the statement that the transaction is done. Public records with the state of Nevada obtained by CNBC indicate that the deal was completed on Feb. 2, with Space Exploration Technologies Corp. listed as the &#8220;managing member&#8221; of X.AI Holdings.</p>
<p>Of particular importance to Musk is the recent installation of his business associate and former SpaceX investor and customer<strong> </strong>Jared Isaacman as the head of NASA. Isaacman has supported speeding up initiatives that would expand the agency&#8217;s contracts with SpaceX. And at the FCC, Chairman Brendan Carr<strong> </strong>has<strong> </strong>been a vocal proponent of SpaceX&#8217;s Starlink.</p>

<p>The landscape for tech mergers has also changed dramatically, with President Donald Trump in the White House and Republicans controlling both houses of Congress. The Federal Trade Commission is now run by Trump appointee Andrew Ferguson rather than Lina Khan, who was known for blocking big tech deals during Joe Biden&#8217;s presidency. </p>
<p>When it comes to AI, Musk&#8217;s longtime friend David Sacks is the White House crypto and AI czar, and has pushed the federal government to limit the amount of oversight AI labs face as they pursue aggressive growth strategies. In December, President Trump signed an executive order issuing a single regulation framework for AI, undermining the power of individual states — namely blue states like California and New York — to implement their own rules. </p>
<p>&#8220;To win, United States AI companies must be free to innovate without cumbersome regulation,&#8221; the order said. &#8220;But excessive State regulation thwarts this imperative.&#8221;</p>
<p>While Musk still has three years left of a second Trump administration, he may have only a small window of unified Republican control, with the mid-term elections taking place in nine months and the president&#8217;s favorability numbers sinking.  </p>
<h2 class="ArticleBody-subtitle">Related party transactions</h2>
<p>Musk is moving fast. And he likely has the backing of a loyal band of investors who have a long history of supporting his intermingling of resources and merging of companies. </p>
<p>In 2016, Tesla acquired SolarCity for $2.6 billion, rescuing it from a looming liquidity crunch. Before the merger, Musk was a key investor in the solar business and served as chairman of the company, which he started with his cousins. </p>
<p>During his leveraged buyout of Twitter (which later became X) in 2022, Musk sold billions of dollars worth of his Tesla shares to finance the deal. He also tapped dozens of employees, even some executives, from SpaceX, Tesla and tunneling venture The Boring Co., to help him with the takeover and to make sweeping changes to the platform.</p>
<p>At Tesla, Musk has engaged in a number of related party transactions with SpaceX and, more recently, xAI<strong>.</strong> For example, Tesla has sold car parts and solar equipment to SpaceX, and the automaker relied on SpaceX to develop a special alloy for its Cybertruck. </p>
<p>In 2025, Tesla sold $430 million worth of its giant backup batteries called Megapacks to xAI, according to a filing out last week, accounting for about 3.4% of Tesla&#8217;s energy business revenue for the year. The batteries help power xAI&#8217;s data infrastructure that it&#8217;s building out around Memphis, Tennessee. </p>
<p>Shortly before that filing landed, Tesla said it was investing $2 billion into xAI as part of the company&#8217;s latest financing round. In July 2025, SpaceX reportedly invested $2 billion into xAI as well. </p>
<p>Farrar said that Musk&#8217;s biggest fans and institutional investors are willing to support the tangled web of transactions, or the &#8220;Muskonomy,&#8221; in part because they understand the symbolic importance of keeping his entire portfolio strong. </p>
<p>&#8220;The whole thing relies on confidence in him,&#8221; Farrar said. &#8220;If any piece of his empire was to fall by the wayside or go bankrupt, then it would undermine everything.&#8221; </p>

<p>Elon Musk&#8217;s pay package of up to $1 trillion highlights the continued escalation in CEO compensation, even as worker pay slows and rewards to shareholders remain mixed, according to several studies.  </p>
<p>Already, Musk is the richest person on the planet with a net worth that tops $660 billion, according to Bloomberg. Musk saw his 2018 Tesla pay package &#8212; now valued at over $130 billion &#8212; reinstated in December, and his company SpaceX looks set to for a potential public offering in 2026. Those two events could well put Musk on his way to becoming the world&#8217;s first trillionaire this year. In addition, his new pay package, valued at up to $1 trillion, could also start paying out over the next decade.</p>
<p>While Musk may be an outlier, his stock-fueled gains highlight the booming compensation and wealth gains of CEOs in recent decades that has been driven by rising stock markets and a broader adoption of stock-centric pay packages </p>
<p>Over the past 50 years, top CEO compensation has climbed 1,094%, according to the Economic Policy Institute. That compares to a 26% increase in typical worker compensation. </p>
<p>Median total compensation for S&amp;P 500 CEO&#8217;s was $17.1 million in 2024, up nearly 10% from 2023, according to Equilar, a corporate analytics firm. CEOs now make 192 times more than the average employee, up from a 186 to 1 ratio in 2023. </p>

<p>Driving the acceleration in CEO pay is a shift in the types of stock awards used to incentivize and reward corporate chiefs. </p>
<p>CEO compensation typically includes four categories: salaries, long-term incentives, short-term incentives and perks. Long-term and short-term incentives are largely stock awards, and make up far and away the largest portion of CEO compensation. Stock awards accounted for 72% of CEO pay packages in 2024, with the median value increasing 15% that year, according to Equilar. </p>
<p>Musk&#8217;s trillion-dollar pay package, for instance, doesn&#8217;t include any salary. The potential value of the $1 trillion would come entirely from stock awards pegged to various targets. For Musk to get the full payout, Tesla must hit key milestones, including certain market capitalization and operational achievements. He could still earn billions in stock even if Tesla doesn&#8217;t meet all the targets.</p>
<p>&#8220;Milestone achievements built into CEO pay packages could be the norm in the future,&#8221; said Amit Batish, senior director marketing at Equilar.</p>
<p>Company boards and CEOs themselves say that because their pay is tied closely to stock performance, their compensation reflects the larger wealth created for shareholders. The CEO only does well if shareholders do well, they argue. If stocks plummet, CEO&#8217;s can also see big pay drops. </p>
<p>Others others argue that CEO&#8217;s have only a partial impact on their companies&#8217; share price. A 2021 MSCI study of top executive pay between 2006 and 2020 found a weak correlation between higher CEO pay and company performance. </p>
<p>&#8220;This notion that the guy in the corner office is somehow almost single handedly responsible for company value, and everyone else is just little minions who don&#8217;t contribute much of anything &#8230; everyone can see that is not true,&#8221; said Sarah Anderson, at the Institute for Policy Studies. </p>

<p>According to the 2021 MSCI study, average performing CEO&#8217;s took home only 4% less in realized pay than top-performing CEOs. More importantly, CEO&#8217;s with the lowest awarded pay saw the strongest returns for shareholders.</p>
<p>&#8220;When we measured pay and performance against CEO tenure, we found little evidence that high CEO pay achieved this lofty goal of CEO incentivization,&#8221; according to MSCI, an investment research firm.</p>
<p>Since the 1990s, company boards have shifted away from stock options, which incentivize short-term performance, with stock awards, which boards argue are driven by longer-term incentives. Shareholders of publicly traded companies can now vote in an advisory capacity on CEO pay, known as &#8220;say on pay&#8221; votes, but company boards have final say when it comes to compensation packages.</p>
<p>While restraining CEO pay has proven ineffective, given the natural &#8220;ratcheting up&#8221; of median CEO pay by board compensation committees, some economists advocate more stock awards for employees to help close the gap between employees and CEOs. </p>
<p>Employee Stock Ownership Plans, or ESOPs, for instance, are qualified retirement plans that give employees shares in the company through a trust. Employees who can partake in ESOPs tend to end up with better financial security, said Loren Rodgers, executive director of the National Center for Employee Ownership. That in turn benefits their companies, he said. </p>
<p>&#8220;Employee-owned businesses are more productive,&#8221; Rodgers said. &#8220;They&#8217;re more able to recruit people. People quit at lower rates. They&#8217;re more competitive.&#8221;</p>

<p>The Environmental Protection Agency closed a loophole this week that Elon Musk&#8217;s xAI had exploited to rapidly stand up its first data center in Memphis, Tennessee. </p>
<p>Musk&#8217;s artificial intelligence startup created a kind of off-grid power plant for its Colossus facility by using a cluster of gas-burning turbines. The company was able to avoid air pollution permitting by classifying the turbines, which were mounted on trailers, as &#8220;non-road engines.&#8221;</p>
<p>The EPA&#8217;s updated rule clarifies that those kinds of turbines can&#8217;t be designated as non-road engines and companies must also obtain Clean Air Act permits before installing them, particularly if their aggregate emissions will go above &#8220;major source thresholds&#8221; of pollution. </p>
<p>The Shelby County Health Department in Memphis previously allowed xAI to designate its turbines as non-road engines, and to start using them without any public comment and environmental impact review, as would have been required in a standard permitting process. </p>
<p>Representatives from the county&#8217;s health department and xAI didn&#8217;t respond to requests for comment. </p>
<p>The move by the federal regulator could slow xAI&#8217;s expansion in the Memphis area as it builds out facilities, packed with <span class="QuoteInBody-quoteNameContainer" data-test="QuoteInBody" id="RegularArticle-QuoteInBody-3">Nvidia&#8217;s<span class="QuoteInBody-inlineButton"><span class="AddToWatchlistButton-watchlistContainer" id="-WatchlistDropdown" data-analytics-id="-WatchlistDropdown"><span class="AddToWatchlistButton-addWatchListFromTag" /></span></span></span> graphics processing units, to develop AI models and services in a booming generative AI market currently led by OpenAI and <span class="QuoteInBody-quoteNameContainer" data-test="QuoteInBody" id="RegularArticle-QuoteInBody-4">Google<span class="QuoteInBody-inlineButton"><span class="AddToWatchlistButton-watchlistContainer" id="-WatchlistDropdown" data-analytics-id="-WatchlistDropdown"><span class="AddToWatchlistButton-addWatchListFromTag" /></span></span></span>.</p>
<p>At the Memphis data center, which first opened in 2024, xAI conducts inference and training for its Grok models and apps, including a chatbot and image generator tightly integrated into the company&#8217;s social network X.</p>
<p>While xAI had previously told Memphis regulators that its turbines would include state-of-the-art pollution controls, known as selective catalytic reduction technology, its supplier, <span class="QuoteInBody-quoteNameContainer" data-test="QuoteInBody" id="RegularArticle-QuoteInBody-5">Solaris Energy Infrastructure<span class="QuoteInBody-inlineButton"><span class="AddToWatchlistButton-watchlistContainer" id="-WatchlistDropdown" data-analytics-id="-WatchlistDropdown"><span class="AddToWatchlistButton-addWatchListFromTag" /></span></span></span> told CNBC in June that it did not install such controls in xAI&#8217;s &#8220;temporary&#8221; turbines.</p>
<p>SEI, a Houston-based energy services provider, has seen its stock price soar in recent months, partly due to xAI&#8217;s expansion plans. SEI didn&#8217;t respond to a request for comment.</p>
<p>Pollution from the turbines has been a major source of local contention. </p>
<p>Last year, residents in the majority-Black community of Boxtown in South Memphis testified at public hearings about a rotten egg-like stench in the air, and the impact of worsening smog on their heart and lung health. </p>
<p>Research by scientists at the University of Tennessee in Knoxville also found that xAI&#8217;s turbine use added to air pollution woes around Memphis.</p>
<p>Environmental advocates, including the NAACP, said they would sue to stop xAI&#8217;s unpermitted use of the turbines. However, they didn&#8217;t file a complaint after the county allowed xAI to treat the turbines as temporary, non-road engines, and issued them permits.</p>
<p>Amanda Garcia, an attorney with the Southern Environment Law Center, which is representing the NAACP, said in an email that her firm will monitor xAI operations to ensure they aren&#8217;t violating terms of their permits, and are operating within the bounds of current EPA rules at forthcoming facilities in nearby Mississippi. </p>
<p>XAI, which recently raised $20 billion from investors including Nvidia and <span class="QuoteInBody-quoteNameContainer" data-test="QuoteInBody" id="RegularArticle-QuoteInBody-7">Cisco<span class="QuoteInBody-inlineButton"><span class="AddToWatchlistButton-watchlistContainer" id="-WatchlistDropdown" data-analytics-id="-WatchlistDropdown"><span class="AddToWatchlistButton-addWatchListFromTag" /></span></span></span>, is currently being investigated in multiple jurisdictions after its Grok and X apps let users easily create and distribute deepfake violent and sexualized images of women and even children.</p>

										<content:encoded><![CDATA[<p>Billionaire entrepreneur Elon Musk persuaded a judge on Wednesday to allow a jury trial on his allegations that ChatGPT maker OpenAI violated its founding mission in its high-profile restructuring to a for-profit entity.</p>
<p>Musk was a cofounder of OpenAI in 2015 but left in 2018 and now runs an AI company that competes with it.</p>
<p>US District Judge Yvonne Gonzalez Rogers in Oakland, Calif., said at a hearing that there was “plenty of evidence” suggesting OpenAI’s leaders made assurances that its original nonprofit structure was going to be maintained.</p>

<p>The judge said there were enough disputed facts to let a jury consider the claims at a trial scheduled for March, rather than decide the issues herself. She said she would issue a written order after the hearing that addresses OpenAI’s bid to throw out the case.</p>
<p>The court battle comes amid a broader showdown over dominance in the market for generative artificial intelligence. Musk’s xAI and its chatbot Grok are competing with OpenAI and other technology developers.</p>
<p>Musk is seeking unspecified monetary damages from what he calls “ill-gotten gains” by OpenAI.</p>
<p>OpenAI and Musk’s artificial intelligence startup xAI did not immediately respond to requests for comment.</p>
<p>Musk contends he contributed about $38 million — roughly 60% of OpenAI’s early funding — along with strategic guidance and credibility, based on assurances that the organization would remain a nonprofit dedicated to the public benefit.</p>

<p>OpenAI, Altman and Brockman have denied the claims, and they called Musk “a frustrated commercial competitor seeking to slow down a mission-driven market leader.”</p>

<p>Lawyers for OpenAI at the hearing asked Gonzalez Rogers to enter judgment against Musk, contending that he had not shown enough of a factual basis to sustain his allegations including fraud and breach of contract.</p>
<p>OpenAI also contends that Musk failed to bring his allegations in a timely manner. Gonzalez Rogers said the jury would be asked to weigh whether the lawsuit was filed outside the statute of limitations.</p>

										<content:encoded><![CDATA[<p>Elon Musk’s firm, xAI, is reportedly in advanced talks to raise $15 billion in new equity – after the billionaire last week slammed a CNBC report about the funding round as “false.”</p>
<p>The deal would hike xAI’s valuation to $230 billion, people familiar with the plans told the Wall Street Journal.</p>
<p>That’s a strong jump from the $113 billion valuation that xAI disclosed after it acquired Musk’s social media platform X, formerly known as Twitter, in March. </p>

<p>Asked for comment, xAI told The Post, “Legacy Media Lies,” in what appeared to be an automated response.</p>
<p>Musk’s wealth manager, Jared Birchall, shared the new fundraising terms with investors on Tuesday night, sources told the Journal.</p>
<p>The outlet reported that it could not be determined whether the new valuation reflects xAI’s worth before or after the $15 billion fundraising round.</p>
<p>Just last week, Musk blasted a CNBC report about the funding round as “false.” </p>
<p>The outlet claimed xAI had added $5 billion to a $10 billion round it had reported on two months ago, citing anonymous sources.</p>
<p>That $10 billion round valued the company at $200 billion, CNBC reported in September. Musk previously called that report wrong, too.</p>
<p>Musk’s AI startup, which was founded in July 2023, has raised billions of dollars as it races to build out massive data centers to compete with rivals like OpenAI.</p>
<p>In June, the firm raised $5 billion in equity and $5 billion in debt to help build out its planned Colossus supercomputer in Memphis, Tenn.</p>

<p>Musk’s space company, SpaceX, invested $2 billion as part of that funding round, according to the Journal.</p>
<p>It has sparked some controversies along the way, with environmentalists blasting xAI’s use of natural gas-burning turbines, arguing they worsen the surrounding area’s air quality.</p>
<p>Some critics have also accused his Grok chatbot and Grokipedia – Musk’s AI-powered alternative to Wikipedia – of bias, though others have praised the site for taking a more neutral stance than lefty Wikipedia.</p>

<p>Lately, Musk has been focused on integrating his many business ventures, pushing for Tesla to invest in xAI.</p>
<p>At a recent shareholder meeting, Tesla investors failed to approve a measure to allow the electric-vehicle maker to invest in xAI. It is now up to the board to decide whether Tesla should back xAI.</p>
<p>Some newer Tesla models feature xAI’s Grok chatbot in their “infotainment” systems. The AI firm, meanwhile, has purchased tens of millions of dollars worth of Tesla’s battery energy storage systems for use in its data centers.</p>
<p>Tesla investors recently passed Musk’s $1 trillion pay package after he threatened to leave if he didn’t get it.</p>
<p>It’s the largest pay plan on record and could make Musk, already the world’s richest person, the first trillionaire – though he will have to hit a series of ambitious goals over the next decade to earn the total sum.</p>

										<content:encoded><![CDATA[<p>Elon Musk’s SpaceX has agreed to pay $17 billion for wireless spectrum licenses from EchoStar to build out its Starlink satellite network, the telecommunications firm said Monday.</p>
<p>The deal includes $8.5 billion in cash and up to $8.5 billion of SpaceX’s stock portfolio for two blocks of wireless spectrum that could expand its reach to cellphone users.</p>
<p>SpaceX also agreed to pay about $2 billion of cash toward interest payments on EchoStar’s debt through November 2027.</p>

<p>The deal comes after the FCC in May warned EchoStar it was investigating its commitment to provide 5G service in the US, questioning its buildout extension and mobile-satellite service.</p>
<p>In a letter to the company, FCC Chairman Brendan Carr said EchoStar wasn’t effectively competing with major wireless carriers using the licenses at its disposal — threatening to strip the company of some of those valuable spectrum rights.</p>
<p>Charlie Ergen, the company’s chairman, met with President Trump in June. Trump later called Carr to take part in the meeting.</p>
<p>EchoStar said Monday it expects the SpaceX deal to resolve the FCC’s inquiries – sending shares in the company soaring 21.6%.</p>
<p>SpaceX could use the new licenses to beef up its home broadband provider through Musk’s Starlink business. SpaceX has also ventured into mobile phones through a deal with T-Mobile.</p>

<p>EchoStar’s wireless licenses would improve Starlink’s ability to connect with cellphones in remote areas out of reach of cellphone towers.</p>
<p>The deal includes rights to provide ground-based 5G cellphone and broadband service.</p>
<p>SpaceX could use the licenses to build a new cellphone service or share spectrum with telecom partners.</p>
<p>T-Mobile is in talks to lease some of the spectrum rights that SpaceX plans to acquire, people familiar with the matter told the Wall Street Journal. </p>

<p>EchoStar recently clinched a deal with AT&#038;T, which agreed to pay $23 billion for wireless spectrum licenses to improve its traditional cellphone service.</p>
<p>AT&#038;T CEO John Stankey called the deal “an opportunistic and pre-emptive asset acquisition,” while EchoStar said the deal is part of its efforts to resolve the FCC’s concerns.</p>
<p>Last year, US satellite TV provider DirecTV terminated its agreement to acquire EchoStar’s satellite television business, which includes rival Dish TV, over a failed debt-exchange offer.</p>

<p>&#8220;If our retro-futuristic diner turns out well, which I think it will, @Tesla will establish these in major cities around the world, as well as Supercharger sites on long distance routes,&#8221; Musk wrote on social media platform X.</p>
<p>He later replied to a user requesting a location in Starbase, Texas, which is home to Musk&#8217;s SpaceX, saying &#8220;Ok.&#8221;</p>
<p>The Tesla Diner has 80 charging stations, two giant megascreens and classic American diner food. It is open 24 hours a day, seven days a week.</p>
<p>Diners can watch movies on two of the 66-foot screens or in their vehicle using the Tesla Diner app. The location features all things Tesla, with merchandise and an Optimus robot serving popcorn.</p>
