										<content:encoded><![CDATA[<p>A former finance executive convicted of helping Charlie Javice defraud JPMorgan Chase into buying the college financial aid startup Frank for $175 million was sentenced on Wednesday to 68 months in prison.</p>
<p>Olivier Amar, who was Frank’s chief growth officer, was sentenced by US District Judge Alvin Hellerstein in Manhattan.</p>
<p>Hellerstein also sentenced Javice to 85 months in prison on Sept. 29. She is expected to appeal her conviction.</p>

<p>Lawyers for Amar did not immediately respond to requests for comment.</p>
<p>Javice founded Frank in 2017 and won praise for simplifying college financial aid for students and parents.</p>
<p>But prosecutors said that when it came time to sell the business, the defendants created a fake customer list, containing real names they bought from data brokers.</p>
<p>Prosecutors said the defendants did this to convince JPMorgan that Frank had about 4.25 million customers, not the approximately 300,000 it actually had.</p>
<p>Both defendants were convicted of bank fraud, securities fraud, wire fraud, and conspiracy to defraud.</p>

<p>Prosecutors said Amar deserved at least six years in prison. Lawyers for Amar sought no prison time, saying he did not engineer the fraud, and lost his livelihood and reputation.</p>
<p>The Montreal native expects to be deported following his sentence, court papers show.</p>
<p>JPMorgan Chief Executive Jamie Dimon called buying Frank a “huge mistake.”</p>
<p>The largest US bank on Monday asked a Delaware judge to end its court-ordered obligation to continue paying Javice’s and Amar’s legal bills, which it said have totaled a “breathtaking” $115 million.</p>

<p>Charlie Javice, founder of a startup acquired by JPMorgan Chase in 2021 for $175 million, was sentenced to just over 7 years in prison Monday for defrauding the bank by overstating how many customers the fintech firm had, Reuters reported.</p>
<p>In March, a 12-person jury found Javice and her chief growth officer Olivier Amar guilty on three counts of fraud and one count of conspiracy to commit fraud. Prosecutors had sought a sentence of 12 years.</p>
<p>Javice, 33, cried as she delivered an emotional statement to the court Monday. Standing to address the judge, Javice said she felt profound remorse for her actions and asked for forgiveness from JPMorgan, employees of the startup, shareholders and investors.</p>
<p>At one point Javice turned and directly addressed her family, sitting in the front row, to apologize and thank them for what she called unwavering support.</p>
<p>&#8220;I will spend my entire life regretting these errors,&#8221; Javice said.</p>
<p>&#8220;I&#8217;m asking with all of my heart for forgiveness,&#8221; she said. &#8220;I ask your Honor to temper justice with mercy … I will accept your judgement with dignity and humility.&#8221;</p>
<p>JPMorgan bought the startup, called Frank, to help the biggest U.S. bank by assets market its financial products to students. Frank was a digital platform that helped students apply for financial aid. In September 2021, JPMorgan told CNBC in an exclusive interview on the deal that the fintech firm had served more than 5 million students since Javice founded it.</p>
<p>But months after the deal closed, JPMorgan discovered that Frank had fewer than 300,000 real customers; the rest were synthetic identities created by Javice with the help of a data scientist.</p>
<p>Javice was arrested in 2023 on charges that she defrauded JPMorgan in the deal. Details that emerged later showed that Frank employees expressed disbelief when Javice directed them to boost their customer roster before the acquisition.</p>
<p>The week before selling her company to JPMorgan, Javice directed an employee to fabricate millions of users. When the employee declined, Javice reassured him, according to testimony given earlier this year.</p>
<p>&#8220;She said: &#8216;Don&#8217;t worry. I don&#8217;t want to end up in an orange jumpsuit,'&#8221; the employee testified.</p>
<h2 class="ArticleBody-subtitle">Not Theranos</h2>

<p>On Monday, Javice&#8217;s attorney Ronald Sullivan argued for a lighter sentence for his client, making the case that Frank helped customers. He contrasted the case against that of Elizabeth Holmes of Theranos infamy, whose fraud he said had &#8220;dangerous medical consequences&#8221; and who was sentenced to 135 months in prison.</p>
<p>&#8220;Ms. Javice&#8217;s sentence should be nowhere near Elizabeth Holmes&#8217;,&#8221; Sullivan told the judge.</p>
<p>Assistant U.S. Attorney Micah Fergenson disagreed, arguing that Javice&#8217;s crime was fueled by greed.</p>
<p>&#8220;JPMorgan didn&#8217;t get a functioning business, they acquired a crime scene,&#8221; Fergenson said.</p>
<p>The episode was embarrassing for JPMorgan, which was thought to be one of the most sophisticated of corporate acquirers. Concerned about threats from fintech and big tech firms, the bank, led by CEO Jamie Dimon, went on a shopping spree of smaller fintech firms starting in 2020.</p>
<p>But JPMorgan, eager to edge out rivals bidding for the startup, failed to confirm that Frank actually had millions of customers before shelling out $175 million for the company.</p>

										<content:encoded><![CDATA[<p>A swanky cannabis store in Southampton has been playing with fire – and now risks getting burned by a clampdown from local authorities.</p>
<p>Last week, Charlie Fox – which has been likened to a Bergdorf Goodman store for weed – opened its doors in the posh Hamptons enclave and was hit with a cease-and-desist order from town officials shortly after its opening.</p>
<p>Late Tuesday, the town’s board fired back – voting unanimously to file an injunction in New York state court to shut down the upscale pot shop, citing a requirement for a “special permit” to open.</p>
<p>Charlie Fox opened its doors in Southampton last week and was hit with a cease-and-desist order from town officials shortly after its opening. <span class="credit">Marcus Martinez</span></p>
<p>Charlie Fox co-founders James Mallios and Julia Levi vowed to fight the town in court, arguing that their state cannabis license supersedes the town’s authority. </p>
<p>“The town of Southampton isn’t a country club or a co-op board. They can’t keep us out. Their actions are harming a small business,” Mallios told Side Dish on Wednesday. </p>
<p>But in a Wednesday interview with Side Dish, Town Attorney James Burke said that even if the state grants businesses a cannabis license, town approval is still required.</p>
<p>“The state’s license doesn’t supersede the town’s approval,” Burke said. “Every state approval is subject to local approval.”</p>

<p>He added that if the court grants the injunction request — which he expects will be filed Wednesday or Thursday — then the town hopes that Charlie Fox will comply and then the town will “consider our options.” </p>
<p>“If they would voluntarily shut down, we would work with them to help them open legally,” Burke told Side Dish.</p>
<p>Mallios – a prominent New York restaurateur who also owns venues including Amali on East 60th Street in Manhattan and Calissa in Water Mill just east of Southampton – claims that town officials failed to exercise their option to opt out of the state’s cannabis program by a 2021 deadline. </p>

<p>Since then, a new group of town officials have unofficially vowed to keep pot shops out, according to Mallios.</p>
<p>“It is shocking to me the lengths to which this town will go to supersede state law and crush a small business,” he fumed. “They can now say our ‘use’ of the space isn’t suitable or appropriate. How dare they! We have a license and we will fight them in court.” </p>
<p>Not so, according to Burke.</p>
<p>“It’s true that the town didn’t opt out of the state program. But special use permits still need to be granted,” Burke told Side Dish. </p>
<p>The town also claims that Charlie Fox’s certificate of occupancy is for a different use and needs to be refiled and that the planning board needs to issue a special permit. </p>
<p>“There are growing pains for everyone — including the state,” Burke added. “My office is working closely with people at the Office of Cannabis Management to get the town in compliance with state regulations. The town can’t be more strict, but we can mirror the state’s regulations, which is what we will try to do.” </p>
<p>Currently, the only place to buy legal cannabis nearby is on the Shinnecock Indian Nation’s territory, on Montauk Highway in Southampton, Burke said.</p>
<p>Two other businesses — Brown Budda and Mottz Green Grocer —  recently filed lawsuits against Southampton, alleging that the town has created arbitrary and illegal barriers that prevent them from opening in violation of state cannabis laws. Charlie Fox has not sued yet. </p>

<p>That subtotal, tallied from just four outlets, does not include dozens of additional simulcasts on Rumble, Facebook and Twitch, nor replays that continue to climb.</p>

										<content:encoded><![CDATA[<p>An “incredibly pissed” Jimmy Kimmel failed to make a deal with his Disney bosses Thursday to return to the air — still balking at their push for him to publicly apologize for his Charlie Kirk remarks, sources say.</p>
<p>The furious ABC late-show host went to his lawyer’s office in Los Angeles that afternoon for a video meeting with Disney TV honcho Dana Walden and ABC late-night head Rob Mills to try to figure out a path forward for his show, “Jimmy Kimmel Live!” sources told The Post.</p>
<p>But neither side could reach an agreement, according to sources and Puck News, which first reported the meeting.</p>

<p>The tense closed-door powwow took place the day after Disney, the parent company of ABC, yanked Kimmel from the air for refusing to cop a mea culpa over his controversial comments Monday and Tuesday about the assassination of conservative icon Kirk and for digging in his heels when asked to tone down his anti-President Trump rhetoric, a source with knowledge of the situation told The Post.</p>
<p>“Jimmy is incredibly pissed, and he’s a guy who never gets angry,” the source said.</p>
<p>The source said Disney execs are looking for a way to reinstate the late-night star while trying to balance the outrage over his comments from the right and sympathetic ABC affiliates with Hollywood’s elite left.</p>
<p>“I think they will reinstate him, but Jimmy could quit,” too, the source noted.</p>

<p>If that happens, the network could end up paying him out of his contract, which is reportedly $16 million a year. A source close to the situation said Kimmel has a year left on his deal.</p>
<p>Reps for Disney and ABC did not respond to Post requests for comment, nor did representatives for Kimmel.</p>
<p>The TV host surfaced Friday dressed in khaki pants, a white open-neck button-down shirt and dark shades getting into a shiny black Audi but declined comment, saying he was just “trying to go to the doctor.”</p>

<p>Disney CEO Bob Iger and Walden, who is known for her great relationships with A-listers, are in the thick of the controversy, too. They are not eager to anger either Hollywood nor the Federal Communications Commission and ABC affiliates Nexstar Media Group and Sinclair Broadcasting.</p>
<p>“Dana is freaking out. Very emotional. Shaken,” another source said of Walden, who has been floated as a potential successor to Iger when he steps down as CEO in 2026. </p>
<h2 class="wp-block-heading">Here’s the latest on Jimmy Kimmel’s suspension after Charlie Kirk comments</h2>
<p>“She has been flamed by her liberal friends and is scared of Trump and what he could do to her CEO campaign. She’s afraid to confront stars like Jimmy and undermine her talent-friendly reputation.”</p>
<p>As for Iger, the source said he is “enraged” — but in true Iger-fashion — not showing it and that he thinks Kimmel needs to “de-escalate” the situation.</p>

<p>“This is a stain on his legacy,” a former ABC exec told The Post of Iger and the controversy. “This will be in the first paragraph of his obituary. It’s that bad.”</p>
<p>Iger’s predecessor, Michael Eisner, weighed in on the mess in a tweet Friday, praising Kimmel as “very talented and funny” and ripping the FCC for its “out-of-control intimidation” of Disney and ABC through its threats to curb the host.</p>
<p>Also supporting Kimmel have been late-night rivals Stephen Colbert, Jimmy Fallon, Seth Meyers and Jon Stewart. </p>

<p>Former “Tonight Show” host Conan O’Brien publicly joined Kimmel’s supporters Friday by tweeting, “The suspension of @jimmykimmel and the promise to silence other Late Night hosts for criticizing the administration should disturb everyone on the Right, Left, and Center.  It’s wrong and anyone with a conscience knows it’s wrong.”</p>
<p>Actor Ben Stiller, comedians Wanda Sykes and Marc Maron and even former President Obama have also thrown their backing behind Kimmel.</p>
<p>Kimmel got into trouble starting early in his monologue Monday night when he began talking about the brutal killing of Kirk at an event at Utah Valley University in Orem last week.</p>
<p>“We hit some new lows over the weekend with the MAGA gang desperately trying to characterize this kid who murdered Charlie Kirk as anything other than one of them, and doing everything they can to score political points from it,” the host said on his show, which is taped in front of a live audience. </p>
<p>Kirk’s accused killer is a lefty trade-school student who is dating a man transitioning into a woman.</p>

<p>FCC Chairman Brendan Carr seized on Kimmel’s comments and told CNBC they “appeared to directly mislead” the public.</p>
<p>In addition, online conservatives accused Kimmel of mischaracterizing the political views of the accused shooter, Tyler Robinson, whose mother said her son had shifted toward the political left and had become “more pro-gay and trans-rights oriented.”</p>
<p>Disney’s decision to suspend Kimmel also came after pressure from Nexstar and Sinclair, the two largest owners of ABC affiliate stations. Nexstar is currently trying to win Trump administration approval for its $6.2 billion acquisition of rival Tegna. </p>
<p>Just a few hours before Kimmel’s suspension was announced, Carr, a Trump appointee, suggested that there was a “strong case” for the FCC to take action against ABC and Disney — calling Kimmel’s comments “truly sick.” </p>

<p>Disney is hoping to stay on the good side of Trump and the FCC after it settled a lawsuit for $16 million with the president last year over defamatory claims by its star anchor George Stephanopoulos.</p>
<p>It is also hoping to maintain its reputation as a home for creative talent. But ending its relationship with Kimmel will likely do major damage.</p>
<p>“It’s a lose-lose situation with Kimmel and ABC,” said a former Disney exec said of the situation. “There is no good solution.”</p>

<p>But one source said Kimmel could come out of this better off. The late night host, who sources told The Post has been angling to retire from his show after 22 years, has been in a ratings rut for the better part of his career.</p>
<p>“The truth is that Jimmy has been mired in second or third place for 22 years. He is very expensive,” the source said. “Jimmy hasn’t had more attention and interest in his entire career. He has been talking about leaving the job for years. He can take his talent to YouTube where he gets more viewers anyway.”</p>

<p>Kimmel got extra support Friday from about 100 people at a protest organized by the Writers Guild of America outside the ABC Disney studios on Hudson Street in downtown Manhattan.</p>
<p>“It’s very possible a late-night host could say something offensive,’’ said Greg Iwinski, 40, a former writer for Colbert Show and John Oliver.</p>

<p>“But the remedy to it is not the FCC guy goes on a podcast a couple hours later, affiliate groups say we’re pulling the show, then the network pulls the show.</p>
<p>“The issue here is that the guy in charge of the public airwaves [Carr] said [Kimmel] should be gone, and by night time, he was gone. So that’s really the issue.’’</p>

										<content:encoded><![CDATA[<p>Comcast’s top brass slammed MSNBC’s coverage of the killing of conservative activist Charlier Kirk — including “insensitive” and “inappropriate” remarks by analyst Matthew Dowd, who was fired on Thursday.</p>
<p>The memo, which was signed by Comcast CEO Brian Roberts, Comcast president Mike Cavanagh and Mark Lazarus, CEO of Versant — the spinoff company that includes MSNBC — was circulated to Comcast and NBCUniversal staff on Friday.</p>
<p>“You may have seen that MSNBC recently ended its association with a contributor who made an unacceptable and insensitive comment about this horrific event,” the memo said. </p>
<p>Matthew Dowd said on MSNBC that Kirk has pushed “hate speech” when asked about the shooting. <span class="credit">MSNBC</span></p>
<p>“That coverage was at odds with fostering civil dialogue and being willing to listen to the points of view of those who have differing opinions. We should be able to disagree, robustly and passionately, but, ultimately, with respect. We need to do better.”</p>
<p>The execs added that staffers must “maintain a respectful exchange of ideas” even if they do not agree with the late Kirk’s political views.</p>
<p>They added that “something essential has fractured in our public discourse,” and that their company has a “responsibility to help mend it.”</p>
<p>Kirk was shot and killed Wednesday at an event at Utah Valley College, prompting a media frenzy and manhunt for the conservative activist’s killer. </p>
<p>During MSNBC’s live coverage of the shooting, anchor Katy Tur asked Dowd about “the environment in which a shooting like this happens.”</p>
<p>Dowd answered: “He’s been one of the most divisive, especially divisive younger figures in this, who is constantly sort of pushing this sort of hate speech or sort of aimed at certain groups. And I always go back to, hateful thoughts lead to hateful words, which then lead to hateful actions. </p>

<p>“You can’t stop with these sort of awful thoughts you have and then saying these awful words and not expect awful actions to take place. And that’s the unfortunate environment we are in.”</p>
<p>The analyst’s remarks sparked outrage online and prompted MSNBC president Rebecca Kutler to issue an apology on Thursday and fire Dowd, whose comments she called “inappropriate, insensitive and unacceptable.”</p>

<p>Comcast — and other major media companies — have been under fire for biased coverage by President Trump and his administration. </p>
<p>On “Fox &#038; Friends” on Friday, Trump commented on the firing of Dowd and MSNBC’s coverage.</p>

<p>“We are talking about radical left networks and cable channels, horrible channels, like MS — I always call it DNC — because it is somehow affiliated with the Democrat National Committee,” he said. </p>
<p>“MSNBC, NBC, ABC, CBS — they’re all terrible. Absolutely terrible and unfair. But even they have been giving it, like, ‘This can’t be allowed to happen.&#8217;”</p>

										<content:encoded><![CDATA[<p>Comedy Central has pulled a controversial “South Park” episode that parodied Charlie Kirk after the conservative activist was gunned down at a Utah college on Wednesday.</p>
<p>The Paramount Skydance-owned network quietly removed the rerun of the episode “Got a Nut” from its cable lineup Wednesday night, just hours after Kirk, 31, was shot and killed while speaking at Utah Valley University.</p>
<p>Instead of airing Season 27, Episode 2 — in which Eric Cartman adopts Kirk’s mannerisms and appearance for a satirical college debate podcast — Comedy Central slotted in Episode 1 from the same season.</p>

<p>The network did not issue a public statement but confirmed to industry outlets that the episode was “temporarily pulled” from its cable rotation.</p>
<p>It remains available to stream on Paramount+ with a subscription. The Post has sought comment from Paramount Skydance.</p>
<p>The decision came as MAGA supporters raged online, accusing “South Park” creators Trey Parker and Matt Stone of helping fuel the hatred that led to Kirk’s assassination.</p>

<p>“Comedy has consequences,” one Turning Point USA staffer posted on Telegram. “Charlie was targeted in the culture before he was targeted in real life.”</p>
<p>The episode originally aired Aug. 6 and immediately drew attention for lampooning Kirk’s college speaking style. The parody climaxed with Cartman receiving the “Charlie Kirk Award for Young Masterdebaters.”</p>
<p>Days later, Kirk himself laughed off the mockery. In a TikTok video posted Aug. 7, he called the segment “hilarious” and told fans he considered it a “badge of honor.”</p>
<p>He also changed his X profile photo to an image of the Cartman caricature wearing Kirk’s signature black T-shirt.</p>
<p>Kirk told Fox News at the time he had grown up watching “South Park” and considered the parody part of being in the public arena.</p>
<p>But after his death, the satire has become a flashpoint. Influential conservative accounts accused Parker and Stone of “mocking his Christian faith” and called them “monsters.”</p>

<p>One post that went viral on X claimed: “They mocked him on TV, then they killed him in real life.”</p>
<p>The outrage left Comedy Central caught in the crosshairs.</p>
<p>Season 27 of “South Park” has already generated controversy despite being only four episodes into its run. The next installment is scheduled to air Sept. 17.</p>

<p>In addition to the Kirk parody, “Got a Nut” featured school counselor Mr. Mackey joining Immigration and Customs Enforcement and staging raids alongside Homeland Security Secretary Kristi Noem.</p>
<p>The episode marked the show’s latest foray into lampooning real-life political figures. </p>
<p>Over its nearly three decades on the air, “South Park” has skewered celebrities, presidents, and pop culture icons across the spectrum.</p>

<p>But this time, the timing has drawn unprecedented backlash.</p>
<p>Kirk, a staunch Trump ally and founder of the conservative youth group Turning Point USA, was shot once in the neck during his Sept. 10 rally in Orem, Utah. </p>
<p>About 3,000 people were inside the campus arena, where Kirk was launching his “America Comeback Tour.”</p>
<p>Utah Valley University police chief Jeff Long said six officers and Kirk’s private security were on hand. “You try to get your bases covered, and unfortunately, today, we didn’t,” Long said.</p>

<p>The suspect remains on the run. Authorities have not released a description.</p>
<p>President Trump confirmed Kirk’s death on Truth Social: “The Great, and even Legendary, Charlie Kirk, is dead.”</p>
<p>The killing has rattled conservatives already on edge after the 2024 assassination attempt on Trump in Pennsylvania. House Speaker Mike Johnson called Kirk’s death “an attack on all of us.”</p>

<p>But within hours, the focus of MAGA anger shifted toward Comedy Central. A petition demanding the network apologize for airing the parody racked up more than 100,000 signatures in its first day.</p>
<p>Right-wing radio host Jesse Kelly told his listeners: “’South Park’ thought it was funny to turn Charlie into a cartoon joke. Now his wife is planning a funeral.”</p>
<p>Parker and Stone have long maintained that no topic is off limits for satire, a stance that has drawn both acclaim and condemnation over the show’s 27 seasons.</p>
<p>Neither creator has commented publicly since Kirk’s assassination.</p>
<p>Funeral arrangements for Kirk have not yet been announced. Turning Point USA said it will hold a memorial rally in Phoenix in his honor.</p>
